AI抢了工作就能裁员?这个仲裁案例给所有职场人提了醒

最近看到工人日报的一篇讨论,刚好戳中了当下不少职场人最担心的问题:如果公司说你的岗位被AI替代了,要把你裁掉,这合法吗?我特意翻了里面提到的真实仲裁案例,看完觉得确实有必要和大家好好聊聊这个话题——毕竟现在“数字员工”早就不是什么新鲜概念,我们每个人都可能遇上类似的情况。

There is a typical case from Beijing that caught our attention: an employee who had been working on manual map data collection for years was fired after the company switched to AI-powered automated collection, with the company claiming “major changes in objective circumstances” made the original contract unworkable. But the labor arbitration committee ruled against the company, pointing out that adopting AI technology is a voluntary business decision for enterprises to improve competitiveness, not an unforeseeable, unavoidable “objective situation”. In essence, the company was trying to shift the risk of normal technological iteration onto workers, which is not legally supported.

这个判决其实给所有企业划了一条红线:不能随便拿“AI替代岗位”当裁员的借口。现在不少企业在引入AI的时候,总觉得技术升级是理所应当的,员工跟不上就该走人,但按照现有的法律框架,主动引入技术革新带来的岗位调整,本质上是企业的经营选择,不是不可抗力,自然也不能让劳动者单独承担成本。更值得注意的是,目前现有劳动法规里关于“客观情况”“重大技术革新”的界定还比较模糊,这也导致不少类似的劳动争议出现时,双方的权利义务都不够清晰。

For workers, this ruling also brings us a very important reminder: we don't have to be passive in the face of AI impact. According to the survey data mentioned in the report, nearly 70% of professionals already hope that companies can provide training on combining AI with their own work, and more than half want to learn how to use AI tools. This shift from “being afraid of AI taking jobs” to “wanting to master AI tools” is actually the right direction for us to adapt to the new era of human-machine collaboration. After all, the best way to avoid being replaced by AI is to become the person who can use AI to improve efficiency.

当然,要解决AI时代的劳动者权益问题,光靠单个案例肯定不够。法律层面需要尽快明确相关的认定标准,比如企业引入AI替代岗位之前,是不是要先和员工协商,有没有义务提供转岗培训?公共层面也需要有更多的技能提升支持,帮大家跟上技术迭代的速度。毕竟技术进步的最终目的应该是让所有人都受益,而不是让普通劳动者为技术升级买单,对吧?
